March 22, 2024 at 11:28 AM #2065434Ok... I have a name: Robert T. Wilson.
Let him tremble for his neck... I'm going after that slaver son of a bitch.
Oh, yeaaAaaaah! 😀
I'm tired of these "gentlemen" who are touching their balls all day without being productive.(This the Capitalism...)March 22, 2024 at 11:47 AM #2065437Then, my reply:
I have received a file report for violating a USA regulation, called DMCA. In Europe, this law has no legislative force, so it only works for your disgusting country. I live in Europe, and I invite you to file a lawsuit if you claim to have the copyright of slaves who barely receive 10% of the total profit.
Greetings, and please remove that complaint from my content on Mediafire, since in Europe, you are an asshole. It's that simple.March 22, 2024 at 11:51 AM #2065438March 22, 2024 at 12:53 PM #2065445Looks like someone didn't read the MediaFire Terms of Service...
"You agree, while using MediaFire Services, that you may not:"
"Distribute Content that violates the rights of others, such as distributing Content that infringes any copyright, trademark, patent, trade secret, or violates any right of privacy or publicity, or that is libelous or defamatory, or that directs any user to the content of a third party without consent of the third party;"
"In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of the Content. You will comply with United States laws regarding transmission of data."
"The Agreement shall be construed in accordance with the laws of the State of Texas, without reference to principles of choice of law. You and MediaFire each irrevocably consent to the personal jurisdiction of the federal or state courts located in Harris County, Texas ("Courts") with respect to any action, suit or proceeding arising out of or related to the Agreement or to the Services and /or Content and waive any objection to venue in any of the Courts for such an action, suit or proceeding; additionally, you agree that you will not bring any such action, suit or proceeding in any court other than the Courts."
No matter where you live, and no matter what the laws are where you live - by using the service, you agreed to use this privately-provided, non-governmental, service under this TOS agreement. You agreed that your use of the service is subject to US law, and specifically, the laws applicable in US -> Texas -> Houston.

Ahh, I love reading poetry early in the morning.
@academicinside - you do know where you are, yes?March 22, 2024 at 1:58 PM #2065450Fuck off Texas, land of anormals!!!
March 22, 2024 at 2:01 PM #2065451And still the copyright and DMCA apply in your case 😉 ToS say clearly that the business is conducted in Texas, so where you live is of no matter/regards. You agreed to them on registration.
March 22, 2024 at 2:01 PM #2065452Oh, absolutely I do.
But that doesn't change anything - except maybe to make responding to MediaFire with such a clear lack of understanding of how the world works even a bit more chuckle-worthy.
Lesson:
Have backup accounts that you access only through VPNs from the same place. When you are inevitably "TOSsed out" on an account by this or that service - you'll have spares that aren't linked to each other. Use getting bounced as a reminder to create a replacement that isn't related to any of the other ones."Ha Ha Ha - Your Laws Don't Apply To Me" as a response is...well - something you only ever wind up saying once. Because you quickly learn that Terms of Service aren't Laws, and they can say basically anything, and by willingly agreeing to use the service, you're willingly agreeing to whatever those terms say.
c.f. Larian's hilarious Terms of Service for Baldur's Gate 3.
March 22, 2024 at 4:50 PM #2065523Did you sign the ToS, witnessed by a notary and had the documents registered in the relevant jurisdiction's notarial archives (or equivalent)?
Guess not. So any legal action should be moot.
The legality of ToS is very questionable especially in online cases. On the other hand the service provider is totally within their rights to withhold further service.
